On September 27, 2011, by means of Decree 3568, established the Authorized Economic Operator (OAS), Some of these benefits are: automatic approval processes, approvals and customs clearance, among others, for all those involved in the management of the international supply chain, provided that high standards of quality, reliability and safety are guaranteed.
Who are the OAS?
Authorized Economic Operator is understood as the natural or legal person established in Colombia, which being part of the international supply chain, performs activities that are regulated by customs legislation or monitored and controlled by the Superintendence of Ports and Transportation, the General Maritime Directorate or the Civil Aeronautics, which through compliance with the conditions and minimum requirements established in this decree, guarantees safe and reliable foreign trade operations and therefore, is authorized as such by the National Tax and Customs Directorate.
Authorized Economic Operators include, among others, importers, exporters and shippers, transporters, intermediaries, port, airport and terminal operators, distributors, operators, integrated and warehouses.
The Authorized Economic Operator in Colombia is a government initiative and has been implemented, involving transversally the entities that directly intervene in the process of entry and exit of goods, as well as those that indirectly promote the development of foreign trade in Colombia, in order to comprehensively ensure safe and competitive conditions in international trade.
Among the objectives set forth for the operation of the Authorized Economic Operator are the following:
- To become a tool for the security of the logistics chain.
- To achieve better levels of competitiveness in the companies.
- Strengthen commercial ties with third countries through Mutual Recognition Agreements.
Benefits
Among the benefits to become an Authorized Economic Operator are the following:
- Recognition as a safe and reliable operator in the supply chain by the control authorities.
- Assignment of an operations officer by each control authority to support its operations.
- Participation in the Congress for Authorized Economic Operators.
- Participation in the training activities programmed for Authorized Economic Operators by the control authorities on matters within their competence.
- Decrease in the number of examinations, physical and documentary inspections for export, import and customs transit operations by the DIAN and decrease in the number of physical inspections for export operations by the Anti-Narcotics Directorate of the National Police.
- Use of special and simplified procedures for the development of reconnaissance or inspection procedures, as the case may be, when these are determined as a result of risk analysis systems by the control authorities.
- Use of special channels and mechanisms to carry out foreign trade operations before the Control Authorities, in accordance with the provisions of a general resolution.
- Direct action of exporters and importers as declarants before the National Tax and Customs Directorate in the import, export and transit regimes.
- Recognition of goods under the terms set forth in the customs legislation, for exporters and importers when they act as declarants and so require.
- Reduction of the amount of the global guarantees constituted before the National Tax and Customs Directorate, under the terms and conditions established by the National Tax and Customs Directorate.
- Authorization to carry out the inspection of exported goods ordered by the National Tax and Customs Directorate and the Colombian Agricultural Institute ICA, at the exporter's facilities and authorized warehouse, when applicable.
- Presentation by the exporters of the Application for Global Shipment Authorization with partial shipments referred to in Decree 2685 of 1999, or the norms that modify, add or substitute it. (Taken from decree 3568)
The implementation of this new figure was from the November 01, 2011For this reason, businessmen interested in accessing the benefits provided through the AEO can start the process to make their foreign trade processes faster, more efficient and generate competitiveness in the market.
Being part of the AEO is not an obligation, but to take advantage of the vote of confidence given by the government and multiple control entities to the businessmen that make up the supply chain, so that they can increase trade, directly reducing the obstacles to Colombian trade.
